1. Acceptance of Terms

By accessing or using Smooth Flick (operated by DIMPLE MAHAWAR at smoothflick.com — our primary domain, with smoothflick.org as a secondary domain), you agree to these Terms of Service, our Privacy Policy, and our Refund & Cancellation Policy.

2. Service Description

Smooth Flick provides AI-enabled workflow and automation tools. Features may change over time as we improve the service.

3. Accounts and Eligibility

You are responsible for account security and for all activity under your account. You must provide accurate information and comply with applicable laws.

4. Acceptable Use

You agree not to misuse the service, violate law, interfere with platform operations, attempt unauthorized access, or use the service to infringe the rights of others.

5. Third-Party Integrations

If you connect third-party services (including Google and the WhatsApp Business Platform / Meta Platforms), you authorize us to access data needed to provide requested functionality, subject to your permissions and our Privacy Policy.

6. WhatsApp Business Platform Use

Smooth Flick is a Tech Provider on the WhatsApp Business Platform and enables you to send and receive WhatsApp messages through the WhatsApp Business Cloud API. When you connect a WhatsApp Business Account and use these features, you agree that:

You will comply with the WhatsApp Business Messaging Policy, the WhatsApp Business Solution Terms, the Meta Platform Terms, and all of Meta's applicable policies.
You will obtain valid opt-in / consent from each recipient before messaging them, keep records of that consent, and will not message users who have not opted in.
You will promptly honour opt-out requests (for example, replies of "STOP") and stop messaging recipients who unsubscribe.
You are solely responsible for the content of your messages, templates, and campaigns, and you will not send spam, prohibited, deceptive, or unlawful content, or exceed applicable messaging limits.
You will provide accurate business information required for WhatsApp Business verification and will not impersonate another business or person.

Note: Message delivery, quality ratings, messaging limits, and account status are controlled by Meta. Meta may review, restrict, suspend, or terminate WhatsApp Business Accounts at its discretion. Smooth Flick is not responsible for, and accepts no liability for, Meta's enforcement actions or for violations arising from your use of the WhatsApp features.

7. AI Features and Output

AI-generated output may be incomplete or inaccurate. You are responsible for reviewing and validating outputs before using them in business, legal, financial, or other high-impact contexts.

8. AI Voice Agent — Compliance Obligations

By using Smooth Flick's telephony AI voice agent features (inbound/outbound calling, campaigns), you agree that you are solely responsible for complying with all laws applicable to automated calling, AI disclosure, and call recording in every jurisdiction where you deploy or receive calls.

🇺🇸 United States

TCPA: Prior express written consent is required before using automated voice systems to contact mobile numbers.
All-party consent states (CA, FL, IL, MD, MI, MT, NV, NH, OR, PA, WA): All call parties must consent to recording. Disclose AI agent use at the start of every call.
FTC/TSR: AI voices used for telemarketing must not impersonate humans. Disclosure is mandatory.
National DNC Registry: You must not call registered numbers without a valid exemption.
Permitted calling hours: Under TCPA/FTC rules, outbound AI agent calls are only permitted between 8:00 AM – 9:00 PM local time of the called party. Many states apply stricter windows. Calls outside these hours are a federal violation.

🇪🇺 European Union / EEA

GDPR Articles 13 & 14: Callers must be informed they are interacting with an AI and that conversation data is processed. A lawful basis is required.
ePrivacy Directive: Automated calling systems require subscriber consent across all EU/EEA member states.
EU AI Act (2024): AI systems interacting with persons must clearly disclose their AI nature. High-risk uses may require conformity assessments.
GDPR Article 17: Recordings and transcripts must be deleted upon request.
Permitted calling hours (EU/EEA): Member-state rules generally restrict automated outbound calls to 9:00 AM – 6:00 PM on weekdays. Saturday calls are restricted in many countries (Germany: until 1:00 PM). Sunday and public-holiday calls are widely prohibited. Verify the rules for each country you call into.

9. Fees, Billing & Payments

Paid plans are billed monthly from the date of purchase via Razorpay, a PCI-DSS compliant gateway. By subscribing you authorise recurring charges to your chosen payment method. All prices are in INR unless stated otherwise.

Refunds and cancellations are governed exclusively by our Refund & Cancellation Policy. In summary: fees are non-refundable except in cases of duplicate charges, verified platform outages exceeding 72 hours, or accidental purchases reported within 24 hours of the transaction. 10. Intellectual Property

Smooth Flick and its platform content are owned by us or our licensors. You retain ownership of content you submit, and you grant us rights required to operate the service.

11. Termination

We may suspend or terminate access for violations of these terms, security concerns, or legal requirements. You may stop using the service at any time.

12. Disclaimer and Limitation of Liability

The service is provided on an "as is" and "as available" basis without warranties to the fullest extent permitted by law. We are not liable for indirect, incidental, special, consequential, or punitive damages.
